SPORTSMANSHIP COMMITMENT, WAIVER OF LIABILITY, MEDICAL RELEASE, HOLD HARMLESS WAIVER, AND PRIVACY POLICY
By registering for any program offered by SAN JOSE RUSH SOCCER CLUB, all participants must accept the following Sportsmanship Commitment, Waiver of Liability, Medical Release, Hold Harmless Waiver, and Privacy Policy before submitting their registration order.
As a participant in organized soccer and other activities organized by SAN JOSE RUSH SOCCER CLUB, I acknowledge and agree to the following:
1. Sportsmanship Commitment:
a. I will not engage in violent conduct or unsportsmanlike behavior on or off the field of play, understanding that such actions may result in dismissal from participation, along with possible loss of payment or dues.
b. I will exhibit good sportsmanship at all times, recognizing that this is a recreational program open to youth of all skill levels, with an emphasis on fair play rather than winning.
c. I will conduct myself appropriately when interacting with youth, parents, coaches, league administrators, and officials.
d. I will report any observed violations of good sportsmanship to the league.
e. I agree to be held financially responsible for any damages or indemnities caused by me willfully, negligently, or otherwise.
2. COVID-19 Mitigation:
a. When an applicable COVID-19 Mitigation Plan is in effect for any program in which I am enrolled, I will adhere to the published guidelines and requirements to the best of my abilities. Failure to comply may result in removal from the program.
3. Assumption of Risks:
a. I understand that soccer is a physical, contact sport that carries inherent risks of injury.
b. I assume all risks and hazards associated with my participation in soccer practices and games.
c. I confirm that I am in proper physical condition to participate and have no illness, disease, existing injury, or physical defect that would be aggravated by my involvement. I will inform the league if my status changes.
d. I acknowledge the risk of loss or damage to myself or my property, including the risk of death or unforeseen consequences due to the unavailability of immediate emergency medical care.
e. I agree to wear properly-fitted and appropriate shoes, as well as any other protective equipment required by soccer rules and safety guidelines issued by the league.
4. Privacy Policy:
a. I authorize the use of my photograph, picture, likeness, and voice to appear in any documentary, promotion (including advertising), social media, television, video, or radio coverage of the league or tournament, without compensation. Participants will not be tagged/identified on these sources without written consent. To opt-out, individuals may email info@www.sanjoserush.com.
5. Waiver of Liability and Hold Harmless Agreement:
a. I release, waive liability, discharge, hold harmless, indemnify, and covenant not to sue the United States Soccer Federation, the State Association, SAN JOSE RUSH SOCCER CLUB, the league or tournament, their directors, administrators, officers, managers, employees, coaches, trainers, volunteers, sponsors, advertisers, and other agents, estates, or executors from any and all liability incurred during my participation in their soccer programs. This includes owners, lessors, lessees of premises, municipalities, government agencies, successors, heirs, and assigns.
6. COVID-19 Specific Release:
a. I acknowledge that participating in SAN JOSE RUSH SOCCER CLUB programs and related events and activities may involve exposure to and the risk of illness from infectious diseases, including but not limited to MRSA, influenza, and COVID-19.
b. I assume all known and unknown risks associated with
these infectious diseases, even if arising from the negligence of the releasees or others, and accept full responsibility for my participation.
c. I agree to comply with all stated and customary terms and conditions for participation concerning protection against infectious diseases. If I notice any unusual or significant hazards during my presence or participation, I will remove myself from the activity and notify the nearest official immediately.
d. I release and hold harmless United States Youth Soccer Association, US Club, NorCal Premier, Cal North, and SAN JOSE RUSH SOCCER CLUB, their officers, officials, coaches, members, agents, employees, other participants, sponsoring agencies, sponsors, advertisers, and owners/lessors of premises used for events from any and all liability, including illness, disability, death, or loss or damage to person or property, regardless of whether it arises from the negligence of releasees or otherwise, to the fullest extent permitted by law.
FOR PARTICIPANTS OF MINORITY AGE (UNDER 18 AT REGISTRATION):
I, as the parent/guardian with legal responsibility for the participant, have read and explained the provisions of this waiver/release to my child/ward, including the risks associated with participation and their personal responsibilities for adhering to rules and regulations related to communicable diseases. My child/ward understands and accepts these risks and responsibilities. I, on behalf of myself, my spouse, and my child/ward, consent to the release provided above for all the Releasees and release and indemnify the Releasees from any and all liabilities related to my minor child’s presence or participation in these activities, even if arising from the negligence of the Releasees, to the fullest extent permitted by law.
For participants in Adult Divisions, the following applies in addition to the above:
ASSUMPTION AND ACKNOWLEDGMENT OF RISKS AND RELEASE OF LIABILITY AGREEMENT
I have read and fully understand the terms of this Release of Liability and Assumption of Risk Agreement. I acknowledge that by signing it, I voluntarily and freely give up substantial rights. I sign this agreement without any inducement.
FOR PARENTS/GUARDIANS OF PARTICIPANTS OF MINORITY AGE (UNDER 18 AT REGISTRATION):
I, as the parent/guardian with legal responsibility for the participant, consent to the release of all the Releasees as provided above. I release and indemnify the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs, even if arising from the negligence of the Releasees, to the fullest extent permitted by law.
